Agreement

These terms are between you and Hamza, who runs Ember. By creating an account or using Ember you agree to them and to the Privacy Policy. If you do not agree, do not use Ember.

Free in this version

Ember is free in this version. There are no payments, subscriptions or paid features. If that changes, I will tell you first and charge nothing without your clear consent.

Your account

  • You must be at least 16 years old.
  • Give a real email address you can read, and keep your sign-in details safe. You are responsible for what happens under your account.
  • One person per account. Do not impersonate anyone or pick a username to mislead.
  • Email support@itshamza.me if you think someone else has access to your account.

Your content

You own what you put into Ember: habits, notes, journal entries and so on. You give me a limited licence to store, process and display it only as needed to run Ember for you and for the people you choose to share with. That licence ends when you delete the content or your account, apart from backups kept for up to 14 days.

You are responsible for your content and for having the right to post it.

Acceptable use

Do not:

  • break the law, or use Ember to harass, threaten, deceive or harm anyone;
  • post content that is illegal or hateful, or that infringes the rights of others;
  • attack, probe or overload the service, bypass rate limits, or scrape it at scale;
  • access data that is not yours, or try to find out private information about other users;
  • create accounts to evade a block or a removal, or send spam.

Social features

  • Profiles and habits are private until you choose to share them. What you share, others may see and screenshot.
  • Friends can react to your shared activity and send you a nudge once a day. Be kind. You can mute nudges and block users.
  • I may remove content, profiles or usernames that break these terms.

Not medical advice

Ember is a habit tracker, not a health service. Habit, quit-tracking, streak, mood and journal features are for self-reflection and motivation. They do not diagnose or treat anything and do not replace professional care. Do not rely on Ember to manage a medical condition, an addiction or your mental health. If you are in crisis or may harm yourself, contact local emergency services or a crisis line.

Availability and no warranty

Ember is run by one person and provided “as is” and “as available”, without warranties of any kind, to the extent applicable law allows. It may be down, change, lose features or have bugs. Keep your own copy of anything important: Settings has a full export.

Limit of liability

To the extent applicable law allows, I am not liable for indirect, incidental or consequential losses, or for lost data, streaks or profits, arising from your use of Ember. Because Ember is free, my total liability for any claim is limited to what you paid me in the 12 months before it, which is zero. Nothing here limits liability that applicable law does not allow me to limit, or your statutory rights as a consumer.

Ending your use

You can stop at any time and delete your account in Settings. I may suspend or close an account that breaks these terms or puts the service or other people at risk. I may also end the service, with reasonable notice where I can.

Changes to these terms

I may update these terms. The effective date at the top shows the latest version. For a material change I will give notice in the app or by email. Using Ember after a change takes effect means you accept it.

Governing law

These terms are governed by applicable law.
